I said you have the right to protect your copyrights, but there's a gray line in how far you can go.
Not crossing that line is asking it to take down clips of their stuff. But that's not what Viacom did. Viacom crossed it long ago when they asked YouTube to take down PARODIES of their stuff, including an episode of the independent "The Happy Show" which is called "The Happy Real Life World" and is a parody of reality TV shows. Even though YouTube is removing videos, that's not enough for Viacom it seems. Now they want a billion dollars from YouTube. A billion dollars? No, I'm not joking. Despite the fact that these corporations are making enemy after enemy every day, they still don't realize they have to give up. They won't stop until all the film in the world is owned by either Viacom, CBS, NBC, Disney, Fox, or Turner. Bullying indie filmmakers into submission is what they're doing. They're well within their rights to not want their stuff being posted on Youtube without permission, but filing a billion dollar lawsuit in spite of Youtube doing what it can to comply? Parodies are protected under copyright law. Doing so using the copyrighted content (actual clips from the show, for instance) isn't.

It depends on the size of the clip. For example, the 4 to 10 second butchered, barely audiable clips YTMND uses don't violate copyright at all.
There's a line between protecting your profits and wanting to make a few extra bucks. This is one of the videos they said violated their copyright. It's called the "Real Happy Life World," and is just a part of an independent show, the "Happy Show." Judge for yourself whether or not this is protected parody. Isn't Viacom the same people who own VH1, MTV, and BET(among other numerous things). so that they can attempt to force feed teens the same bilge on every channel.
Viacom is simply ran by people who have ingested too much lead. So after screwing out of MTV, and somewhat leaving us with VH1 both truly shells of their ormer glory, they want to take away our newest enjoyment, youtube. 1.5 billion dollars is a far cry from just wanting to get your copyright respected. Also, I didn't see anything wrong with that video in terms of violating copyright. On another note, though...
Viacom, apparently, sent a email to the owner of that particular video an "apology" detailing how they "un wrongfully" marked his video. It brought up a interesting point. Besides the estimated number of copyright infringing videos, what's the estimated margin of error if they ended up marking that video out of the vast amount of others? Quote Suck it Viacom. There were other videos, too. Just go to YouTube, search "Viacom" and you'll come up with a lot of video complaints that Viacom tagged their non-Viacom video. The Electronic Frontier Foundation is trying to get victims of Viacom's attack to fight them. -CSM

Not sure if this has been brought up yet (I'm sick and feverish - I actually stayed home yesterday, and that's certainly a first for me!) but am I the only one feeling like this is an intimidation tactic that will shortly be followed up by an offer by Viacom to buy YouTube? Wouldn't surprise me.
Either way, I don't think Viacom stands much of a chance with their case. As someone said, parodies are protected by copyright laws under certain circumstances which, I believe, were respected in this case. Maybe it's just going to be one of those court things that go nowhere and turn out being a battle between who can keep spending money to keep the case going longest. Watch Viacom then attempt to assimilate YouTube... Meh. GMH- I meant "conservatism" in the sense that they're refusing to move forward with technology. As in- "Getting with the times."
